By accessing the Jobling website or any of our services, You agree to the following terms as our user (As Freelancer). We may reserve the right to modify these terms and conditions at any time without any prior notice. Jobling.com, the website is an online platform as a service to users' online marketplace, which helps users to buy and sell seller Services. Before using, any of our services Buyers and Sellers must register with an account in order to buy or sell their services. Jobpling enables/acts as a workplace/platform to work together online. We are not a party to any contractual agreements between Buyers and Sellers online, We are acting as a platform and provide our services for Buyers and Sellers to Buy and Sell their services.

We may change or add information, to this website without any notice to anyone. If you or any user is identified as a misbehavior user we may ban your account without any notice or warning. If your account is banned we are not responsible for any of your earning balances/services.

All verified user accounts are associated with registered individuals on Jobpling.com. Users should not share login credentials/personal information with others. The individuals with the account will be held responsible for all actions taken by the account, without any limitation.

Note: Unusual account activities lead to account suspension or bans on Jobpling.com.

Subject to your local laws, a person over 18 can create, verify, and use their own account on this website, however, if your/user age is below 18 you are able to use an account with the permission of the account holder. If we identified any of the account reports by the owner or as identity theft we take immediate action to suspend the accounts.

Users may associate with their real details, business name, or a company name, Which is associated with their account. this User Agreement is a contract with the User as an individual (not the business or company) and Users remain solely responsible for all activity undertaken in respect of their Account.

A company, corporation, trust, partnership, or other non-individual corporate entity may be a User subject to an eligible corporate account that pays corporate subscriptions.

We may, at our absolute discretion, refuse to register any person or entity as a User.

You cannot transfer or assign any rights or obligations you have under this agreement without prior written consent.

Using Jobpling Account

While using this website, As a verified user you will not attempt to or otherwise do any of the following:

1. Posting content in inappropriate categories or areas on our Websites and services;
2. Post false, inaccurate, misleading, deceptive, defamatory, or offensive content (including personal information);
3. Infringe any laws, terms, third-party rights, or our policies, Such as user policy, Privacy policies;
4. Fail to deliver payment or service delivered to you;
5. Fail  to deliver Seller Services purchased from you;
6. Try to manipulate our fee structure, the billing process, or fees owed to Users;
7. Try to transfer your verified account (Including feedback) and username to another party without our consent;
8. Distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes;
9. Distribute malware. Viruses, any other technology that may cause harm for other users on this website or Jobpling.com, interests or property of Freelancer users (including their Intellectual Property Rights, privacy, and publicity rights) or is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or which may harass or cause distress or inconvenience to, or incite hatred of, any person;
10. Download and aggregate listing from Jobpling.com for display with the same listing from others without our express written permission, "frame", "mirror" or otherwise incorporate any part of the Website into any other website without our prior written authorization;
11. Try, attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the Website;
12. Sell, harvest, or otherwise collect information about Users, including email addresses, without their consent.
13. Copy, modify, and distribute rights or content from the Website or Freelancer's copyrights and trademarks;

Finance

This section describes how we handle finance, taxes, currency rates, and maintain account thresholds on our website. These constants of data can be changed anytime without any prior notice. If you are not ok with these terms please don’t use any of our services, otherwise, we are not responsible for any of your matters with our financial term notices.

Taxes

As a verified user of Jobpling.com, you are responsible for paying any taxes, including any services or value-added taxes, which may be applicable depending on the jurisdiction of the services provided.

Depending on your residency or location, you may be subject to certain ad valorem or other taxes, on certain fees that we charge. These taxes will be added to fees billed to you, if applicable. As well as buyers shall withhold tax on your payment on your payment to sellers, if applicable. You may acknowledge that you must comply with your jurisdiction's obligations under income tax provisions.

Currently, we comply with all taxes according to the Inland Revenue Act no.24 of 2017 and other related taxes if it is applicable. We collect a charge of tax fees on users and withhold taxes on payment (ACT NO 24 OF 2017 and all other amendments)

Fees

We do not charge additional charges or fees for this website. There is only 8% of the rate we collect from (orders when they are completed). Please follow the terms under Rates to learn more about these charges. However, we display rates here if we add any of your value-added premium plans and fees. These are the current charges we do,

• After completing the order by a freelancer, we take/charge 6% of the service charge from your account if you completed the order as a freelancer.
• From the side of the Client, we charge 2% of the service charge when you buy an order as a freelancer on the Jobling platform.

These are the current service charges rates on the Jobpling platform. These rates aren’t constant. At any time, we are entirely able to change up or down these rates with the taxes and other service charges of our third-party service providers.

Rates

The "Flexible Rate Charge" (or FRC for short) is a rate that can fluctuate and is currently set at 8%. These rates can be changed without any prior notice. Rates are only calculated because of the cost of the platforms, the taxes, and other party APIs that are used on this platform (Jobpling.com).

Account threshold

At Jobpling.com, we strive to provide a seamless and secure platform for our users to earn and withdraw their earnings. Please note that we reserve the right to change the minimum withdrawal threshold at any time, without prior notice.

While our current minimum withdrawal threshold is set at 1000 LKR, we may change this threshold in response to business needs or changes in market conditions. Any changes to the minimum threshold will be effective immediately and will be communicated through our website and other communication channels as appropriate.

We may also implement additional measures to verify your account information and ensure that all withdrawals are processed accurately, which may affect the time required for processing your withdrawal request.

Currency rates

At Jobpling.com, we use LKR as the base currency for all transactions on our platform. This means that all earnings and payments are processed in LKR. Please note that the exchange rate may vary depending on market conditions and fluctuations in currency exchange rates.

We may also make changes to the base currency without prior notice, and any changes to the base currency will be effective immediately. We will do our best to inform users of any changes to the base currency through our website or other communication channels as appropriate.

You are not permitted to use your seller or buyer feedback, including your composite ratings or feedback comments, for any purpose other than on a website operated by Jobpling.com or its related entities, without our written permission.

1. Unless otherwise agreed with us, you must not advertise an external website, product, or service on Jobpling.com. Any website address posted on the website, including in a listing, bid, listing description, clarification board, or message board, must relate to a job listing, user, or service being offered on the website.
2. We may display advertisements or promotions on the website. You acknowledge and agree that we shall not be responsible for any loss or damage of any kind incurred by you as a result of the presence of such advertisements or promotions or any subsequent dealings with third parties.
3. You acknowledge and agree that the content of any advertisements or promotions may be protected by copyrights, trademarks, service marks, patents, or other intellectual property or proprietary rights and laws. Unless expressly authorized by Jobpling.com or third-party right holders, you agree not to modify, sell, distribute, appropriate, or create derivative works based on such advertisement/promotions.

1. Jobpling.com may use third-party services such as Google AdSense, and Ezoic Ads to display advertisements on the website. Communication with Other Users

Communication

1. You must not post your email address or any other contact information (including but not limited to Skype ID or other identifying strings on other platforms) on Jobpling.com, except in the "email" field of the signup form, at our request, or as otherwise permitted by us on the website.
2. Unless you have a prior relationship with a user, you must only communicate with users via Jobpling.com. You must not, and must not attempt to, communicate with other users through any other means, including but not limited to email, telephone, Skype, or any other third-party platform.
3. We are not allowing any video or audio conference features to communicate with our platform, however, If Users use any third-party service and it's Concerning video chat and audio chat, any terms agreed to between users must be confirmed in writing using the chat or direct message function. because it's a third-party matter.

User Information

1. Jobpling.com may use information such as your name, location, display or username, and/or your image concerning the provision of messaging services on the website or in mobile apps.
2. We may read all correspondence posted to the website and download or access, and test (if necessary), all uploaded files, programs, and websites related to your use of the website to investigate fraud, regulatory compliance, risk management, and other related purposes.

User Identity

At our request, you may need to provide us with additional information that allows us to identify you, such as your date of birth or other relevant information. You may also need to confirm that you own your email address or financial instruments or have your information verified through third-party databases or other sources.

If we request it, you must provide us with copies of identification documents, such as a passport or driver's license. We may also require you to provide photographic identification holding your identification document alongside a sign with a code that we provide as an additional identity verification step. Additionally, we reserve the right to request a video interview with you to validate your identity, background, and skills.

We reserve the right to limit or suspend access to your Jobpling.com account, website, and/or services if we are unable to obtain or verify the information we require under this section. We may update your information on the website to match any identity document that you provide. Furthermore, any disbursements, such as wire transfers from the website, will only be made to the beneficiary matching the identity documents and account information that you provide.

If you are not verified by Jobpling.com, you may not be able to withdraw funds from your account, and other restrictions may apply. For more information, please refer to our Know Your Customer and Identity Verification Policy. Please note that payments will not be released for fake accounts.

Customer Support

Once a Buyer awards a Project or Contest to a Seller and the Seller accepts on the website, or a Buyer purchases an item from the Seller, both parties are considered to have entered into a User Contract where the Buyer agrees to buy and the Seller agrees to provide the Seller Services. As a User, you must not enter into any contractual provisions that conflict with the User Agreement. It is your responsibility to ensure that you comply with your obligations to other Users, and you may become liable to a User if you fail to do so. You must also ensure that you are aware of any relevant domestic or international laws, regulations, statutes, ordinances, or common law that apply to your use of the website as a Buyer or Seller.

If another User breaches their obligations to you, it is your sole responsibility to enforce any rights that you may have, and we are not responsible for enforcing any rights under a User Contract. It is important to note that Sellers and Buyers may have certain rights under statutory warranties that cannot be excluded by applicable law.

The User Agreement is drafted to ensure compliance with unfair contract legislation and does not violate any laws relating to unfair contracts. To the extent that any part of the User Agreement conflicts with inalienable rights under local laws, all parties intend for the agreement to be read down only to the extent necessary to comply with such local laws and no further.

Each User acknowledges and agrees that the relationship between Buyers and Sellers is that of independent contractors, and nothing in the User Agreement creates a partnership, joint venture, agency, or employment relationship between Users. Furthermore, nothing in the User Agreement should be construed as forming a joint venture, partnership, or employer-employee relationship between Freelancer and any Client.

Funds

If you have prepaid fees or charges or paid for services through Jobpling.com, you may have positive funds in your Account. Sellers may also have positive funds if they have completed a project or sold an item and received payment.

However, it is important to note that funds in your Account are held by Jobpling.com in our operating accounts with financial institutions and are not held separately. They may be commingled with our general operating funds or the funds of other Users. You are not entitled to any interest or earnings for funds in your Account.

If your Account has negative funds, we may set off the negative amount with any funds that you subsequently receive into your Account. We may also reverse payments made from your Account to other User Accounts or deduct amounts you owe us from future deposits into your Account. If we set off a negative amount, it may be bundled with another debit coming out of your Account.

Please note that Jobpling.com is not a bank or licensed financial institution and does not provide financial services to you. The funds in your Account represent our unsecured obligations to you for your rights to direct us to make payments concerning the purchase and sale of services through our platform. Any refunds required will be returned only to the original payment source and funds are not insured or guaranteed. Funds may only be loaded or released through Jobpling.com and may be commingled with other Users' funds and our own funds.

Limit and Fraud Prevention

At Jobpling.com, we take fraud prevention seriously. Therefore, we reserve the right to suspend any withdrawal request if we suspect that the funds' source is fraudulent. In case we identify any funds received into your account as a result of a fraudulent transaction, we will reverse them immediately. If the funds have already been released to you, you must repay them in your account. Failure to do so may lead to the suspension, limitation, or cancellation of your account, and we may take action to recover the funds.

Additionally, we may choose to place a limit on any or all of the funds in your account, preventing any use of the funds, if we believe that there is an unacceptable level of risk associated with you, your account, or any of your transactions. This includes instances where we suspect a risk of reversal or chargeback. We may also place limits on your account if we suspect fraudulent or other unacceptable behavior, while we investigate the matter.

In certain circumstances, if you are involved in a dispute, we may temporarily limit the funds in your account to cover the potential liability amount. If the dispute is resolved in your favor, we will lift the limit and release the funds to you. However, if the dispute is not resolved in your favor, we may remove the funds from your account. We may also limit the funds if we believe that the payment is being made to a country where we do not offer our service or if required to do so by law or applicable law enforcement agencies.

Refunds

At Jobpling.com, you are entitled to request a refund for any funds paid into your Account, except in cases where the refund relates to a Milestone Payment, or if it pertains to fees or charges owed to us.

If your refund request is related to a Milestone Payment. If it pertains to our fees and charges, you must follow the process specified in the "Disputes with Us" clause.

If we approve the refund, the funds will be returned to you via the same payment method(s) used to make the original payment to us.

In certain circumstances, we may refund funds to you even if you haven't requested them. These circumstances include:

1. when we are legally required to do so;
2. when refunding funds will prevent disputes or cost increases for us;
3. when we follow any refund policy specified by us;
4. when we discover the original payment was fraudulent;
5. when you have made a duplicate payment in error; or
6. when we believe, in our sole discretion, that refunding the funds is necessary to prevent a credit card chargeback.

To request a refund, please contact our customer support website or email us at finance@jobpling.com. If you have made a Milestone Payment, you agree to use the dispute resolution process outlined in this agreement and accept its ruling. You also agree not to initiate any chargeback requests with your card issuer.

If you initiate any chargeback requests or similar processes, you consent to us sharing any and all information related to these terms and conditions to defeat such requests.

If you have already initiated a chargeback request with your credit card issuer, please do not request a refund from us, as this would result in a double recovery.

If we determine, based on relevant circumstances, that you have made an excessive or unreasonable number of refund or chargeback requests, we may suspend, limit or close your Account. Please contact finance@jobpling.com for any finance-related queries.

Automatic Refunds and payment cuts

We process automatic withdrawals for these specific circumstances. Otherwise, you must contact us and request manually for refunds. Before applying for the refunds please read our refund policy, terms according to refunds, and also FAQs under the refund process.

1. If the freelancer didn’t deliver the project at the promised time duration, Payment will be fully refunded to the user who brought the project, However, we cut 8% of our rates from the Freelancer. If you have already funds in your account it will be automatically charged, or it will be charged with your (Freelancer/Seller) next very first order.
2. Clients are not able to cancel orders. If anyone needs to cancel placed order contact us immediately, However, we will charge our Rate of 8%, (on the client side) our rate, when you cancel placed order and do the refund.

If there are any matters related to our (Jobpling.com) Automatic Refunds and payment cuts please contact us immediately.

Automatic Refunds are only proceeded according to the noted circumstances here. We do not proceed/plan with any automatic refund process without notice under the  Automatic Refunds and payment cuts.

Withdrawal

To withdraw funds from your Jobpling Account, you must be Verified by Jobpling, as part of our anti-fraud and Know Your Customer policy. Details on how to become Verified by Jobpling can be found in the Know Your Customer and Identity Verification Policy.

Please note that we may require you to provide additional information or verify your identity at any time, as part of our anti-fraud and Know Your Customer policy. However, with our system, there is no withdrawal holding time, and withdrawals are only released to verified users."

Triple Manual Withdrawal Guarantee, Every user is guaranteed three manual withdrawal processing opportunities per month. If these are not used, their earnings will be automatically withdrawn to the provided bank account at the end of every month. 

Account Close and Deactivate

At any time, you have the option to close your User Account by requesting us to delete or deactivate your Account. However, please note that closing your Account is subject to certain conditions, including the absence of any active listings on our Website, resolution of any ongoing matters such as a suspension or restriction on your Account, and settlement of any outstanding fees or debts owed on the Account. It's important to note that we may need to retain some of your personal information to fulfill regulatory requirements and external obligations. Additionally, closing your Account may not result in the complete deletion or removal of all the information we have on file.

Also if your user account is banned or suspended we automatically close your account.

After you close your account your threshold will be also released to your bank account within 3 months.

* NOTE: If you deactivate or close your account keep noticing you cannot be able to use our website, Jobpling.com within 1 year, Once your registration details have been removed from our website database, you can create a new account on our website.

How do I release a Milestone Payment®?

Releasing a payment is all about saying "good job" to the freelancer. You'll review

what they've done for the milestone, and if you're happy with it, you can release the funds. Keep in mind that once you do this, it's final, so make sure you're satisfied before hitting that button.
